Purposes of the processing of personal data

Your data is used to process your request with regard to the implementation of pre-contractual measures, the fulfilment of a contract or the protection of our legitimate interests or those of a third party. This data shall be processed pursuant to Article 6(1)(b) and 6(1)(f) of the GDPR. We additionally process your data in order to fulfil legal obligations (such as regulatory requirements and commercial and fiscal retention obligations) in accordance with the corresponding statutory provisions in conjunction with Article 6(1)(c) of the GDPR. Insofar as you have given us your consent, processing shall also take place pursuant to Article 6(1)(a) of the GDPR.

Pursuit of legitimate interests of controllers or a third party

Our legitimate interest in the processing of data consists in the handling of your request insofar that this is not based on the implementation of pre-contractual measures or fulfilment of a contract. The legitimate interests or fundamental rights and freedoms of the user of the contact form do not preclude the processing, as the data are provided voluntarily and the rights of the data subjects are ensured.

Recipients of the personal data

To complete your request, your personal data will be transmitted where necessary to the following categories of recipients: companies affiliated with KOMSA AG in accordance with Section 15 of the German Stock Corporation Act (AktG):

  • IT service providers (providing information and telecommunications services)

  • Shipping companies (delivery of ordered goods or documents)

  • Customer service providers (contacts for enquiries relating to your request)

  • Mailing services, printing shops, postal and parcel services (printing and dispatch of advertising and information material)

  • Providers of document- and data-destruction services (professional disposal of documents and data media)

Insofar as you have given us your consent, your data will also be transmitted to the following recipients:

Duration of the storage of personal data

Following completion of your request, your data will be deleted within a period of 30 days insofar as this is not precluded by statutory or official retention obligations. Corresponding obligations of proof and retention are based inter alia on the German Commercial Code (HGB) and the German Fiscal Code (AO). Accordingly, the retention period is up to six years.      

Information on personal data with regard to rectification, erasure, restriction or objection

We expressly draw your attention to your rights pursuant to Articles 15 to 21 of the General Data Protection Regulation. These include the right of information vis-à-vis the controller in respect of your personal data, their rectification and erasure, as well as restriction of processing and the right to data portability.

You furthermore have the right to object to the processing of your personal data.

Withdrawal of consent

Insofar as you have consented to us processing your data, you have the right to withdraw this consent at any time. The lawfulness of processing based on consent before its withdrawal shall remain unaffected. For detailed information on withdrawal, please refer to the declaration of consent.

Right to lodge a complaint

We draw your attention to your right to lodge a complaint with a data protection supervisory authority concerning the processing of your personal data.

Provision of personal data

The provision of data is not a statutory or contractual requirement or a requirement necessary to enter into a contract. Data is provided on a voluntary basis. If data is not provided, it is not possible to handle your request.
